Most regional centers require the child to be at least 18 years old so that the child is compliant with contract law considerations that differ from a state-by-state basis. When the applicants file the I-526 petition, the age of their child is frozen. Once their I-526 petition is approved, the age of their child is no longer frozen. If the principal applicant can file for the conditional green card within one year of approval of the I-526 petition, there would be no danger of aging out.
